Terms & Conditions*
- The Lagotto Romagnolo Dog Rescue, Inc. (“LRDR,” “us” or “we”) and the undersigned (hereinafter referred to as “Adopter” or “you”), in consideration of the terms, conditions and promises set forth in this Adoption Contract (“Agreement”), intending to be legally bound thereby, agree to the following terms and conditions:
- 1. LRDR is conditionally placing the following described Dog with you, the Adopter, for adoption by you as a pet/companion Dog, on the terms and conditions set forth herein.
- 2. Adoption Fee: In exchange for the Dog, the Adopter agrees to pay an adoption fee to LRDR. This will be considered an adoption fee and is non-refundable, except as expressly contemplated below in section 2a.
- 2a. The Adopter hereby agrees to have the Dog spayed/neutered by the date LRDR has provided separately through email. Notwithstanding the foregoing, the Neuter/Spay Date may be extended at the recommendation of a qualified veterinarian, (as long as documentation is provided) if and only if, LRDR agrees to the extension in writing.
- 3. You understand that this Dog was previously unwanted, a stray or lost and may have been rescued by us from a dangerous, unhealthy and/or cruel situation. This could have long-lasting effects on the Dog. You agree that LRDR is making no representations or warranties about the condition, personality, or temperament of the Dog. Dogs that come into rescue have been determined and appear to be a Lagotto Romagnolo, as per the AKC breed standard, but no DNA testing has been done to confirm the Dog’s breed. The breed standard is broadly written and open to interpretation. There is no guarantee of lineage, pedigree or the like. All animals are inherently unpredictable and may subject the Adopter to health and safety risks.
- 4. Care of the dog: You agree that the Dog will be provided with clean fresh water, wholesome dog food, adequate outdoor exercise, appropriate veterinary care and affection, and at least 8 hours per day socialization with the family. Appropriate veterinary care includes but is not limited to, yearly physicals, yearly vaccinations, flea, tick (where geographically appropriate) and heartworm prevention. You also agree to take the Dog to vet visits at any point in which the Dog exhibits signs of illness. The Dog may not under any circumstances be crated or otherwise confined for more than 8 hours in a 24-hour period and if crated the crate shall be large enough for the Dog to lie comfortably on its side. The Dog will live inside the Adopter's home and will not be isolated from the family. The Adopter will never let the dog run loose or roam, keep the dog chained or tied up, keep it continuously in a yard, garage, patio, balcony, or pen, or leave the dog outdoors, even in a fenced yard, when no one is at home. The Adopter will not have the Dog attack-trained, nor will the Adopter use it for any purpose other than companionship. The Adopter will never allow any physical, mental, or emotional abuse of the dog.
- 5. Identification The adopted Dog must be licensed in accordance with the laws of the jurisdiction in which the Adopter resides. The adopted Dog will wear a form of identification with the Adopter’s name and phone number at all times. The dog has a microchip which will be registered to the new owner and the LRDR, Inc will be listed as an alternative contact.
- 6. Veterinary Care: You agree to have the Dog examined by a licensed veterinarian within 7 days of adoption. You agree to keep all legally required vaccinations current including and not limited to Rabies, DHLPP, and to ensure that the Dog receives preventative medicine to protect against heartworm, fleas, and ticks. Additionally, you hereby agree and consent to the Area Rescue Volunteer inquiring with your veterinarian about the Dog after the adoption, you will instruct your veterinarian to cooperate with and supply copies of complete medical histories and treatments to Area Rescue Volunteer. You further agree that the Area Rescue Volunteer or designee has your permission to look over your property at a mutually convenient time to ensure compliance with the conditions set forth in this Agreement.
- 7. Transfer; Euthanasia. The Adopter is adopting the Dog for themselves and agrees to not give away, sell, or trade the Dog, even as a gift to a friend or family member. The Adopter will neither take the Dog to a shelter nor abandon the Dog. The Adopter understands that they must notify LRDR, without delay, if the Adopter can no longer care for or keep the Dog and agrees to give LRDRa reasonable time to evaluate the Dog and decide appropriate action moving forward. The Adopter is responsible for all logistics/expenses to physically return the Dog to an LRDR representative if needed. The Adopter must notify LRDR of any behavioral problems that have occurred at any time before the Adopter returns the Dog, and the Adopter agrees to pay for a professional trainer’s evaluation in the case of biting or aggression BEFORE attempting to return the Dog. LRDR has the right of first refusal and must be notified first of any decisions regarding placement of the Dog. You agree that you may not euthanize the Dog except in the case of the Dog’s terminal illness, injury, or old age accompanied by pain and suffering.
- 8. Lost Dog You agree to make a serious effort to find the Dog if it becomes lost, by immediately filing a lost report with the local police, animal control authorities, animal shelters, SPCA’s and local veterinarians, and posting lost Dog signs, and contacting us immediately should the Dog become lost.
- 9. Training The Adopter agrees NOT to use pinch, prong, shock, choke, chain or other aversive training methods. If behavioral issues arise with the Dog, you will seek professional care and/or training, including, but not limited to, behavior modification.
- 10. Breach of Agreement; Liquidation Damages. In the event that we make the determination in our sole discretion that you have failed to comply in with any of the terms of this Agreement, or we determine the Dog is abused or neglected, as determined in our sole discretion, LRDR may immediately demand return of the Dog from you and upon demand, and you must immediately surrender the Dog to LRDR. In addition, without waiving any of our rights under this Agreement, if you do not immediately surrender the Dog to us, you must pay $300.00 to LRDR, as the amount agreed between us as just and reasonable liquidated damages to compensate LRDR for our costs and expenses, including legal fees, court costs and attorney fees in connection with your breach of this Agreement and our subsequent enforcement thereof.
- 11. No Liability; Hold Harmless. Neither LRDR, its volunteers, officers or directors, is liable to you for any claims, legal actions, losses, injuries, damages, costs, expenses, or liabilities whatsoever in connection with your adoption or ownership of the Dog. The Adopter agrees to accept responsibility and ownership of the Dog at the Adopter's own risk. The Adopter, and for the Adopter’s spouse, heirs, executors, personal representatives and assigns agrees never to bring a claim or suit against LRDR. The Adopter releases LRDR and its directors, founders, employees, officers, agents, representatives, contractors, volunteers, successors and assigns from all liability arising from the adoption or behavior of the Dog. The Adopter understands that this agreement discharges LRDR and its directors, founders, employees, officers, agents, representatives, contractors, volunteers, successors and assigns from any liability to the Adopter and the Adopter’s spouse, heirs executors, and assigns, with respect to bodily injury, personal injury, illness, amputation, scarring, death, property damage or other loss that may result from the adoption or behavior or activities of the Dog. The Adopter releases LRDR and discharges LRDR and its directors, founders, employees, officers, agents, representatives, contractors, volunteers, successors and assigns from any liability for LRDR’s own negligence or liability that may result in bodily injury, personal injury, illness, amputation, scarring, death, property damage or other loss to the Adopter. The Adopter agrees that LRDR may use any photograph of the Adopter and the Dog taken by LRDR or its agents, or provided by the Adopter to LRDR, in promotional materials, consents to LRDR’s use of the Adopter’s likeness in such promotional materials, and specifically releases LRDR from any claim arising out of LRDR’s use of the Adopter’s likeness or photographs of the Adopter in such promotional materials.
- 12. Entire Agreement; Modification; Binding Effect. This Agreement constitutes the entire agreement between the parties, and supersedes any prior understandings between the parties with respect to the subject matter of this Agreement. No modification of this Agreement will be valid unless it is made in writing and signed by both parties. This Agreement is binding upon you and your heirs, assigns, successors, personal representatives and executors.
- 13. Governing Law; Venue. All claims or causes or action (whether in contract, tort or statute) that may be based on, arise out of or relate to the adoption or this Agreement, shall be governed by, and enforced in accordance with, the internal laws of the State of Oregon, including its statutes of limitations. The sole and exclusive jurisdiction of any suit related to or arising out of this Agreement shall be the Multnomah County Circuit Court in Portland, Oregon. You waive any objection to jurisdiction and venue that you may otherwise have to this venue for any such lawsuit.
- 14. Severability. If any provision of this Agreement is deemed to be invalid or unenforceable in any respect for any reason, the validity and enforceability of such provision in any other respect and of the remaining provisions of this Agreement will not be impaired in any way.
- 15. Attorney Fees. If any arbitration, suit, or action is instituted to interpret or enforce the provisions of this Agreement, to rescind this Agreement, or otherwise with respect to the subject matter of this Agreement, the party prevailing on an issue will be entitled to recover with respect to such issue, in addition to costs, reasonable attorney fees incurred in the preparation, prosecution, or defense of such arbitration, suit, or action as determined by the arbitrator or trial court, and, if any appeal is taken from such decision, reasonable attorney fees as determined on appeal.
- The undersigned does hereby waive all liability against LRDR and its members, volunteers, directors and officers and release and covenant to hold harmless LRDR and its members, volunteers, directors and officers from any claims, damages, or actions incurred because of the adoption or caused by any action of the Dog transferred hereby.
- I (we) have read and fully understand the terms and conditions of this agreement. I (we) further understand that if I (we) fail to comply with any of the terms specified herein, LRDR has the right to reclaim the dog and enforce this contract in a court of law.
